1. General Provisions

1.1 Contract Formation

The Provider agrees to sell, and the Passenger agrees to purchase, the Service in accordance with any quotation or reservation accepted by both parties. These Terms and Conditions shall govern the Contract, overriding any other terms proposed or implied by either party.

1.2 Acceptance of Terms

A contract is established when the Provider accepts a reservation. By placing a reservation through the Provider’s website (http://www.flyoncars.co.uk), phone, or representative agent, the Passenger agrees to these Terms and Conditions.

1.3 Amendments to Terms

The Provider reserves the right to update these Terms and Conditions at any time without prior notice. Updates will be posted on the Provider’s website and will become effective one hour after posting.

1.4 Reservation Confirmation

Reservations are not considered accepted until confirmed in writing (via email, phone, or other means) by an authorized representative of the Provider.

 

2. Service Specifications and Changes

2.1 Service Description

Services will be provided as per the Provider’s sales documentation unless explicitly varied and agreed upon in the Passenger’s reservation. Images and descriptions on the Provider’s website or materials are illustrative and not legally binding.

2.2 Changes to Services

The Provider reserves the right to adjust service specifications to meet safety, statutory, or regulatory requirements, provided such changes do not materially affect the service performance.

2.3 Subcontractors

Subcontractors are not authorized to make representations about the Service unless confirmed by the Provider in writing. Passengers waive claims based on unconfirmed representations.

 

3. Pricing and Payment

3.1 Pricing Validity

Prices listed on the Provider’s price list are valid at the time of acceptance. Quotes are valid for 24 hours unless otherwise specified.

3.2 Price Adjustments

The Provider may adjust prices to reflect unforeseen costs (e.g., exchange rates, regulatory changes) by notifying the Passenger prior to delivery.

3.3 Holiday Surcharges

Reservations for services on December 24th, 25th, 26th, 31st, January 1st and any other specified dates will incur a 100% surcharge on published prices.

 

4. Terms of Carriage

4.1 Booking Responsibility

Passengers are responsible for booking airport transfers in accordance with airline check-in times and guidelines.

4.2 Waiting Time Charges

  • Non-airport: 5 minutes of free waiting; 40p per minute thereafter.
  • Airport: 60 minutes of free waiting after flight landing, with additional waiting at 40p per minute. Flight delays do not incur extra charges.

4.3 Luggage Responsibility

The Provider is not responsible for loss or damage to luggage. Passengers must ensure luggage is securely loaded and unloaded. Drivers may refuse excess luggage that compromises vehicle safety.

4.4 Prohibited Items

The Provider does not permit transportation of hazardous or prohibited items, including explosives, firearms, perishable goods, illegal drugs, or pets (except registered guide dogs).

 

5. Cancellations and Charges

5.1 Cancellation Policy

Cancellations must be confirmed via email or phone at least 24 hours before the booking time. Charges apply as follows:

  • 24+ hours prior: £10.00 cancellation fee.
  • 3–24 hours prior: 50% of the quoted price.
  • Less than 3 hours: 100% of the quoted price.

5.2 No-Shows

Reservations will be classified as a no-show if the Passenger is unreachable for 1 hour (address collection) or 3 hours (airport collection).

 

6. Liabilities and Limitations

6.1 Force Majeure

The Provider is not liable for delays or failures caused by factors beyond its control, including but not limited to:

  • Natural disasters
  • Traffic disruptions
  • Strikes or industrial actions
  • Flight delays or cancellations

6.2 Liability Exclusion

The Provider is not responsible for consequential losses, including profit loss or indirect damages, arising from service delivery or delays.

 

7. Miscellaneous Provisions

7.1 Contractual Waivers

No waiver of any contractual term shall be deemed valid unless explicitly agreed upon by both parties.

7.2 Governing Law

These Terms and Conditions are governed by the laws of England and Wales.
